I need help in KY

i am looking for help for issues in KY. I have a collection agency calling about one of my debts. They have been ugly....talking over the top of me....acusing me of fraud.....harassing me with degrading comments by saying "what kind of job do you have that you so important that you can't talk about this issue at work" I want specifics about what my rights are in KY....what type of attorney i should contact.....what is the law with garnishments in KY. Any suggestions would be helpful

Are you currently enrolled in any kind of debt elimination plan? If so, that company may be able to provide you with resources to combat this. If you'd like to explore your legal options with regard to this collector, you should seek a consumer rights or consumer advocacy attorney in Kentucky. Let me know if you need a referral. I am not enrolled in a debt elimination plan but have been investigating and exploring it. In doing so, I have found numerous companies, most of which are not in Louisville. I have consulted CCCS in the past but found them to not be very user friendly. It was a struggle to get an appointment and their office was not well staffed and hard to find....like it was all a secret or something. Could you recommend any other companies? There seems to be alot and it feels like something I need to be careful with. I would also like a referral for an attorney to discuss the KY laws and represent me in case I need it in this situation. I currently already have a garnishment for my student loan and cannot get another one for fear that I will lose my job.....and that won't help anyone get their money. Other than my student loan, my debt is not large. I do not own any property. I am interested in looking at my whole situation--the garnishment, other debts, getting out of debt as well as taking care of this rude, obnoxious collector.

This account was turned over to the collector on Aug 15th and he stated first that I had to come up with the money by 5pm on the day I spoke with him, then he said he could do 2 payments....one by friday 25th and the other within 25 days. Then he asked what i could do and he promptly dismissed it without ever letting me finish presenting it. When i told him that i would not give him a post dated check immediately, He berated me and told me he would call his client and tell them that i refused to pay and then hung up. Are these just tactics....could I call the creditor and workout something at this stage? at the very least, to better represent myself with them?...will they file suit immediately and if they do how much time do I have to respond? I guess that I am really just looking for advise on how to take care of myself in this situation.

Based on the contents of your inital post, the collection agency has committed violations of the FDCPA. The problem is, unless you recorded the phone conversations, you have no proof.

If it was turned over to the collection agency on Aug 15, you are still within the 30 day window to exercise your validation rights. Do not waive this right!

Has the CA sent you anything in writing? From the date of inital contact, they have 5 days to send you your validation rights in writing. If they failed to, that's another violation.
