being sued

I am currently working with a debt settlement company. I spoke with a debt collector the other day and they told me I would possilbe looking ata litigation to be sued. they told me they could take my house or car away from me. They are aware I am working with a debt settlement company. Is it possible they can do that in california?

A creditor cannot take away

A creditor cannot take away your house or your car. In fact, they may be breaking the law by threatening to do so. Contact the United Consumer Advocacy Network (UCAN) www.ucan.net.

Also, read about the Fair Debt Collection Practices Act (FDCPA).

I just wanted to point out

I just wanted to point out that the creditor may actually be able to take the person’s house or car if the house or car were used as collateral (i.e. w/ a secured debt).

Also, while most states won’t allow a forced sale of a home or car for unsecured debt; some states may in certain situations. For example, there are states that will allow an unsecured creditor to perform a forced sale of a non-primary residence (e.g. vacation or rental property).
