I need advice---desperately
I went to the bank this morning and found that my account had been frozen by Mitchell N. Kaye who I have later found out is not licensed by the city and has a bad rep with the Better Business Bureau. This stems from a 1991 credit card bill for a little over $1800 which is over $4000 now. The collector claims this is the result of a judgment against me in 1994. I never received a summons to go to court. I had already moved from the address they had, and even if I hadn't it was a rooming house and anyone could have gotten the summons and not given it to me. In recent days, I have not received anything stating that the judgment was going to be placed. I spoke to the company today and even though I dispute the amount offered a payment plan so my funds could be released. My rent is due tomorrow, and my money is all tied up. All he said was "Can you borrow the money from someone?" Over and over again. Then, he refused to work out a plan with me and told me that he will wait til Friday to see how much is in my account before he releases it. Now, I have direct deposit. I received some free legal advise and was told to stop it which I did. I begged this man to be understanding but all he said was "Don't call me until Friday. I won't speak to you until then." I feel this is unfair if I am willing to make a plan. I even told him to garnish my salary, but he refused. What recourse do I have?

I need help finding examples of responses to summons to appear in court. I recieved one from one of my creditors. I am with a debt settlement company and they said i could find them on this site.Cant seem to find them.

I received a summons to pay
I received a summons to pay a debt and I tried numerous times (within the 30 day time frame)to contact the agency. The 30th day will be tomorrow (10/30/09). I am going to write a letter to refute the summons due to the inability of the debt collector to return my calls. I found out when opted out to the operator that the person who has my account is on maternity leave and they were not sure how long she would be on leave. I asked for her Supervisor's name and was forwarded to his extension and did not receive a return call from him as well. I will be sending a letter certified receipt but is it a good idea to fax a copy of the letter to the debt collector as well because the deadline to respond is tomorrow? I am unemployed and would like to make a payment arrangement (although I can not pay much). I can not afford an attorney and I do not have much money and I do not know much about the legal process and I am now grasping at straws... YOUR ADVICE AND HELP IS GREATLY APPRECIATED! Also, is there any example of a letter that I could view for direction.

It sounds like you should contact an attorney. Talk to a licensed attorney in your state and make sure you tell them this company isn't licensed.
